On April 16, 2019, Gov. Phil Bryant signed Senate Bill 2828, the Mississippi Guardianship and Conservatorship Act. The legislation has been referred to as the “Guard and Protect (GAP) Act”.
In summation, the legislation, which will be effective January 1, 2020, repeals Chapter 13 of Title 93 of the Mississippi Code, which pertain to guardians and conservators.
Upon the new year, this area of law will be governed by a new regime, being the GAP Act.
Based on a cursory review of the GAP Act, procedures and pleadings will need to conform to the new law upon it being effective.
